Successful Industrial Disease Claims

Below you will find a few examples of successful industrial disease claims that Rosemary has dealt with from Thompsons NI Belfast office.

Unsafe workplace caused occupational dermatitis

Rosemary’s clients in this case were a group of employees working for a manufacturing company which failed to provide their staff with a safe working environment. As a result, several of them developed occupational dermatitis.

Rosemary successfully fought for compensation on their behalf. Although she had to issue proceedings she was able to settle the cases before the trial for a range of damages between £5,000 and £17,500.

Industrial deafness arising from noisy equipment

Rosemary’s client in this case had worked as a sheetmetal worker / panel beater for over 40 years for two employers. Both failed to issue him with ear protection in the early years of his employment, despite being exposed to noisy equipment. After 30 years, it was discovered that he was suffering from industrial deafness.

Rosemary contacted all the insurers for both employers to maximise the amount of compensation she could recover for her client. Although she had to issue proceedings, the case settled for £20,000 before going to trial.

Hand Arm Vibration Syndrome following exposure to hand-held tools

Following many years of exposure to hand-held tools such as drills, riveting machines, rivet guns and milling machines, Rosemary’s client noticed a number of symptoms of vibration white finger. These included numbness and tingling as well as blanching to the fingertips.

The man’s employer denied liability, so Rosemary had to issue proceedings. However, after joint consultation she was able to settle the case for £20,000.

Rosemary has also acted for a number of other employees in the same workplace, who suffered similar injuries as a result of using vibratory equipment. She managed to settle these claims, almost invariably after issuing proceedings, for a range of damages between £7,500 and £20,000.
